Schedule – Terms & Conditions of Entry 

Information on how to enter and prizes set out in this Schedule form part of the Terms & Conditions of Entry (Terms). These Terms constitute the entrant’s agreement with the Promoter in relation to the entrant’s participation in the Promotion. The Terms must be read together with the Schedule for this Promotion. To the extent of any inconsistency between the Schedule and these Terms, the Schedule prevails.

Entry Restrictions

Entry to the Promotion is open to Australian residents in all Eligible States/Territories who: 

  1. fulfil the method of entry requirements; and 
  2. are 18 years of age or older; and 

directors, management, employees, officers and contractors (and their immediate families) of: 

  1. the Promoter; 
  2. any Third-Party Supplier (as defined below); 
  3. any related bodies corporate of the Promoter or any Third-Party Supplier (as defined below); and 
  4. any agencies or companies associated with this Promotion, 

are ineligible to enter. 

“Immediate families” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor. 

Entry Mechanics

To enter the Promotion, participants must, during the Promotional Period: 

  1. follow the Promoter’s Instagram account: @kadiluggage; and 
  2. tag at least one (1) friend on the competition post on the Promoter’s Instagram account. 

Each tag of a friend on the competition post constitutes one (1) entry. For example, tagging ten (10) friends on the competition post is equivalent to ten (10) entries. 

Entrants can only enter in their own individual capacity and from an Instagram account which they hold in their own name. Entering under a false name/s may invalidate all entries. Multiple entries under different names may also invalidate all entries at the Promoter’s discretion. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid. 

Entrants can enter as many times as they like provided each entry is submitted separately in accordance with these Terms. There is no limit on the number of entries. 

Entries must be received during the Promotional Period and in accordance with these Terms. Entries will not be accepted in any other way or form or at any other time.  An entry will be deemed to have been received when the Promoter actually receives it (not when it was submitted). Incomplete and ineligible entries will be deemed invalid. The Promoter will also invalidate any entry which (in its opinion) breaches these Terms or any other content guidelines published by the Promoter as part of the entry process for the Promotion. Once submitted, entrants cannot alter or delete their entry. 

The Promoter is not responsible if an entrant’s mobile device, laptop, desktop computer or equivalent device is not sufficiently capable for the purposes of submitting an entry.

Prize Draw 

This is a game of chance and skill plays no part in determining the winner. 

Based on a single random draw, one winner will be selected at the conclusion of the Promotional Period. 

The draw will be held at 12:00pm (AEST) on Thursday, 7 August 2025 at 41-39 Mount St, Prahran VIC 3181. 

The first one (1) valid entries drawn randomly from the entries received during the Promotional Period will win the Prize. 

The winner will be announced on the Promoter’s Instagram and will be entitled to receive the Prize noted below. 

The Promoter may draw additional reserve entries in a draw and record them in order, in case winning entries/entrants are deemed invalid, or a Prize is unclaimed (Reserve Entrants). 

Prize

There is one (1) Prize available to be won in this Promotion. Each Prize comprises of A Dine & Bathe Gift Certificate for Two (valued at $360) and A full Kadi Forrest Green Luggage Set (Valued a $1223).

Prize Conditions  

Each Prize is not transferable or exchangeable and cannot be redeemed for cash or any other form of consideration. The value of each Prize is based on recommended retail prices (inclusive of GST) and is accurate at the time of preparation of these Terms. The Promoter accepts no responsibility for any variation in the value of each Prize after that date. 

If a Prize is unavailable for any reason, the Promoter may substitute it for another item of equal or higher value, subject to any written directions of a regulatory authority.

To secure your preferred date and location it's best to make bookings well in advance. 10% surcharges apply on public holidays and bathing bookings made on same day as visitation. Treat this certificate like cash as lost or stolen certificates cannot be replaced or refunded.

Any costs not expressly included in the Prize description are the responsibility of the winner.

Notification of Winners

The winner will be notified by email, phone or private Instagram message on Saturday, 7th August 2025 and will be provided with instructions which they must follow to verify their entry and claim their Prize. 

Prize Delivery 

To claim the Prize, the winner must follow the instructions set out in the notification message sent to them informing them that they have won the competition. This includes providing verification information regarding their entry, if requested by the Promoter. 

If a Prize winner complies with these Terms, and the Promoter has verified and accepted the entry in accordance with these Terms, the Promoter will deliver the Prize to the winner (in the form of an e-ticket) within 24 hours of the winning entry being verified, to the email address or mobile phone number provided by the winner at the time of completing their entry or via the verification process.

Unclaimed Prize Allocation 

Prize Claim Date: 12:00pm (AEST) on Monday, 9 August 2025

If a Prize has not been accepted or claimed by the Prize Claim Date above or if, after making all reasonable attempts, the Promoter cannot contact the winner (or the winner does not contact the Promoter) by the Prize Claim Date above, the relevant entry will be discarded and the Promoter will re-award the Prize to a Reserve Entrant (and once verified, that Reserve Entrant will be deemed the winner for the purposes of these Terms). 

Any such winner in this process will be informed by email, phone or private Instagram message on the Prize Claim Date and will also have their last name, initial of their first name and postcode of residence published on the Promoter’s Website. 

Collection and Use of Personal Information 

Each winner and their companion must take part in all publicity, photography and other promotional activity as the Promoter reasonably requires, without any compensation.  

Each winner and their companion consent to the Promoter using their name/s and image/s in any promotional or advertising activity. 

The Promoter may collect their personal information directly or through its agents or contractors (including any Third-Party Suppliers). The Promoter will use such personal information to conduct and manage the Promotion. 

The Promoter may disclose each winner and their respective companion’s personal information to its related companies, agents or contractors (including Third-Party Suppliers) to assist in conducting this Promotion, communicating with them or storing data. This may include disclosures to organisations outside Australia. 

By entering, entrants consent to the Promoter keeping their personal information on its database to use for future marketing purposes, including contacting entrants by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends to entrants that they may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering, entrants consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this Promotion.

Terms & Conditions of Entry (Terms) 

These Terms must be read together with the Schedule for this Promotion. The Schedule defines certain terminology used in these Terms. 

Entry 

  1. By entering the Promotion, entrants accept these Terms. 
  2. Entry is open only to entrants who comply with the Entry Restrictions and who follow the Entry Mechanics. 
  3. Entries must be received by the Promoter during the Promotional Period. 
  4. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. 
  5. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. 
  6. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. 

Entry Content 

  1. Each entrant must take full responsibility for the content of their entry, and for ensuring their entry complies with these Term. This includes text, photos, videos, email messages and anything else that the entrant submits, uploads, transmits, publishes, communicates or uses in connection with their entry into the Promotion. 
  2. The Promoter may at any time, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entry that is within its possession or control without notice to the entrant, or require the entrant by notice to take such action in respect of content within their possession or control. 

Prizes 

  1. The Prize will be awarded to the winner drawn in accordance with the Prize Draw. 
  2. The winner will be notified in accordance with the Notification of Winners. 
  3. The Prize will be delivered to the winner in accordance with the Prize Delivery. Once any Prize has left the Promoter’s (or supplier’s) possession or control, the Promoter will not be responsible for any loss or damage to the Prize. 
  4. In the event of a Prize not being accepted or claimed, the Prize will be deemed forfeited unless the process for Unclaimed Prize Allocation applies. 
  5. The Promoter may require the winner to provide proof of a valid entry prior to being awarded a Prize. 
  6. The Promoter may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this Promotion by, any person who fails to provide an adequate identification to the satisfaction of the Promoter, or who tampers with or benefits from the manipulation of, or tampering with, the entry process, or the operation of the Promotion or acts in violation of these Terms, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. 
  7. If, due to any reason whatsoever, the Promoter becomes aware after an entrant has won a Prize that the entrant has not complied with these Terms, that entrant will have no entitlement to the Prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of Promoter, to return, refund or otherwise make restitution of the Prize. 
  8. The Prize cannot be transferred or exchanged (except as set out in these Terms). Any Prize that has been transferred will be deemed void and the parties involved will be disqualified from the Promotion. Without limiting any other term of these Terms, the Prize (and any element of the Prize) must be taken as and when specified or will be forfeited with no replacement. 

General 

  1. Any disputed matters about the conduct of the Promotion or the allocation of a Prize should be put to the Promoter in writing via hello@kadiluggage.com. The Promoter will use best endeavours to respond to disputed matters within 5 working days. To the furthest extent permitted by law, the Promoter’s decision in relation to all aspects of this Promotion is final and no correspondence will be entered into. 
  2. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond control of the Promoter, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant authorities in the Eligible States/Territories if required. 
  3. Without limiting any other paragraph, the Promoter may at its discretion amend any of this Promotion or of these Terms, subject to applicable laws and any notifications required to be made to relevant authorities in the Eligible States/Territories if required. 

Liability 

  1. Nothing in these Terms limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
  2. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law) including the Non-Excludable Guarantees. 
  3. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. 
  4. Facebook, YouTube, Instagram, TikTok, or Snapchat may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, YouTube, Instagram, TikTok or Snapchat; and to release Facebook, YouTube, Instagram, TikTok, or Snapchat from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not Facebook, YouTube, Instagram, TikTok, or Snapchat. 
  5. Unless the contrary intention appears, a reference in these Terms or Schedule or in advertisement relating to this Promotion to ‘dollars’ or ‘$’ is a reference to the lawful currency of Australia.
  6. The Promotion and these Terms will be governed by the law of the State or Territory in which the Promoter ordinarily resides. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with disputes concerning the Promotion.
